American San Francisco Commission on Human Rights rejects Falun Gong's groundless complaint

On October 31, 2006, Virginia Harmon, executive chairman of American San Francisco Commission on Human Rights, decided to overrule Falun Gong's groundless complaint about the Chinese Chamber of Commerce's discrimination against Falun Gong in participating in Chinese New Year Parade. On November 9, Falun Gong practitioners in San Francisco gathered outside the city hall to demonstrate against this decision, claiming "this decision was unfair and almost not based on the facts". However, American San Francisco Commission on Human Rights waved aside this display of opinion and declared that they would not accept any new appeal made by Falun Gong. Falun Gong has undergone a total defeat.

At the beginning of this year, American San Francisco Chinese Chamber of Commerce turned down Falun Gong's request to participate in Chinese New Year Parade, because Falun Gong had taken advantage of Chinese New Year Parade of 2004 and 2005 to carry out unlawful propaganda for the purpose of slandering and attacking China's government. Their practice had seriously affected the happiness and harmony of Spring Festival of China Town in San Francisco. So American San Francisco Chinese Chamber of Commerce rejected Falun Gong for fear that "a black sheep" would again ruin the Chinese Spring Festival "feast" they have well prepared. The ferocious Falun Gong went into hysteria and charged against Chinese Chamber of Commerce and made complaints to American San Francisco Commission on Human Rights.

Epoch Times and Minghui Net, the so-called "biggest media in the world" run by Falun Gong, began to make insistent clamor. For example, from January to the middle February, Epoch Times had published successively more than 20 articles of this kind. Furious in diction and vehement in emotion, all the articles were dead against Chinese Chamber of Commerce.

However, Epoch Times only reprinted one article related to this issue in March and kept silent at it in April. On May 24, San Francisco civil court held a court for the first time about the case concerning Chinese Chamber of Commerce's discrimination against Falun Gong in Chinese New Year Parade. Epoch Times only gave a very simple report to the case respectively on 26 and 28. Then it presented no new reports. Why did Falun Gong shout itself hoarse to make trouble at first, but made such a dejected retreat at last?

Clearly Falun Gong has no power over American courts. In July, San Francisco superior court ruled against Falun Gong in the case concerning Chinese Chamber of Commerce's discrimination against Falun Gong in Chinese New Year Parade. The court ruled that Chinese Chamber of Commerce had the right to refuse the applicant's request for the participation in its Parade according to the American constitution, so Chinese Chamber of Commerce had no violation against Falun Gong's civil rights. In addition, the judge Ronald Quidachay offered six reasons to support his verdict. First, the plaintiff Falun Gong couldn't prove that it was greatly harmed because its request for the participation in Chinese New Year Parade was turned down by the defendant Chinese Chamber of Commerce. Second, the defendant had sufficient proof that the plaintiff had disturbed the former Parades, so the defendant had the right to reject the plaintiff's application for this year. Third, the defendant's right to free speech was protected by American Constitution, so the defendant could refuse the plaintiff to participate in the Parade. Fourth, the defendant's right to refuse the plaintiff to participate in the Parade was also protected by American law. Fifth, the plaintiff had confused street meetings with Parade. Lastly, the plaintiff couldn't prove that its appeal was to stick up for people's interest; instead the support for the defendant's right to free speech could well reflect the protection of people's interest. The judge also ruled that the plaintiff should pay the legal fare of this case. (Reported by Singtao Daily)

No doubt, such a verdict left Falun Gong media no chance to utter a word.

In fact, with a closer reading of the reports by Falun Gong media, one is sure to find Falun Gong's self-depression. It was reported on Minghui Net on March 4 , "On March 1, 2006, the (American) magazine Front Page published an article titled 'Red Star Shining on San Francisco' in which San Francisco boasted about its melting power and took great pride in its commission on human rights. However, when Falun Gong practitioners required to participate in 2006 Chinese New Year Parade, San Francisco has not lived up to its words."

It seemed that this failure had not totally discouraged Falun Gong. They made a complaint to San Francisco Commission on Human Rights. It turned out that San Francisco Commission on Human Rights held a public hearing in the city hall and rejected Falun Gong's complaint. Soon the Commission sent the written judicial order both to Chinese Chamber of Commerce and Falun Gong. According to this judicial order, the Commission found no evidence to prove that Chinese Chamber of Commerce discriminated against Falun Gong's belief, or humiliated Falun Gong in public intentionally. The Commission held that there was no proof that Falun Gong had been treated unfairly  because of their request for participating in the Parade being turned down.

Such a farce played by Falun Gong came to the end. What would be Falun Gong's reactions? Maybe they would resort to silence just in the same way they responded to the failure in the former lawsuits. Maybe they would continue to apply to transfer the case to a higher court for rehearing. In fact, they have invented many farces of this kind, such as the so-called "excruciation", "Sujiatun Case" and "organ transplantation". So those tricks were not new at all and could be seen through from the first sight. But pig-headed Falun Gong will cling to them and employ them over and over again.

In any case, Bai Lan, the consultant of Chinese Chamber of Commerce, deserves our respect. She is dedicated to the popularization of Chinese culture and the flourish of China Town. She cannot bear with those with ulterior intentions to make use of San Francisco Chinese New Year Parade to blow their anti-China trumpet. But the evil Falun Gong media hate her so much that they have adopted many malicious words to inveigh against Bai Lan, such as "secret agent", "puppet", "shrew", "butcher" and "bitch". So it is clear that Bai Lan's human right has been seriously violated and it is none other but Bai Lan who deserves legal protection.
