OREGON CITY, OR (KPTV) -A case involving parents who chose prayer over medicine for their daughter has been dismissed by a judge.

A judge ruled Thursday that a 3-year-old girl is safe in the custody of her parents, Timothy and Rebecca Wyland.

The Oregon City husband and wife were indicted in July 2010, found guilty of criminal mistreatment in 2011 and sentenced to 90 days behind bars.

They are members of the Followers of Christ Church and had stated medical care conflicted with their religious beliefs. Their daughter suffers from a growth of blood vessels known as a hemangioma, which affected her eye socket and threatened her vision, according to doctors.

They lost custody of the girl in 2010 for failing to seek medical care for her. Custody was returned at the conclusion of their criminal case, but the state maintained a supervisory role with regular checkups.

In July 2012, a judge ruled the state would remain involved in the case after Timothy Wyland testified under oath he could not guarantee continued medical treatment without the court's involvement.

A report at that hearing from the Department of Human Services noted  in the girl's condition, and cooperation from her parents who had been attending medical appointments as part of their three-year probation.

On Thursday, a judge said Timothy Wyland promised to follow doctor's orders and provide medical care for the girl.
